Privacy Policy

What information POW Ink collects, what we do with it, and what we don't do with it. Plain English up top. The formal language below it is what's legally binding.

Section 1

The short version

In short

We collect what you give us — name, email, optional phone, what you want to talk to us about. We use it to respond to you, process your order, and route your artwork to the supplier producing your goods. We don't sell your data. We don't have ad trackers. Our analytics are cookieless.

This Privacy Policy describes how POW Ink [ATTORNEY REVIEW — entity form] ("POW Ink," "we") collects, uses, shares, and protects information when you use our website, request a quote, place an order, or otherwise interact with our services. By using the services, you acknowledge this policy. If you do not agree with it, do not use the services.

This Privacy Policy operates alongside our Terms of Service and our Cookie Policy.

Section 2

Who we are

In short

POW Ink is the data controller. We're based in Watford City, North Dakota. Privacy questions go to privacy@powink.com.

POW Ink [ATTORNEY REVIEW — confirm entity name and form on finalize] is a North Dakota limited liability company with its principal place of business at 214 19th Avenue NW, Watford City, ND 58854. POW Ink is the entity responsible for the collection and processing of personal information described in this policy (the "data controller" under applicable privacy law).

Privacy questions, data-rights requests, and notices under this policy go to privacy@powink.com.

Section 3

What we collect

In short

From you directly: contact form fields, account info if you sign up, the artwork and order details you send us. From your browser: minimal analytics about which pages get visited, with no cookies and no individual tracking.

We collect information in the following categories:

What we do not collect. We do not collect government-issued identification numbers (SSN, EIN of individuals where not necessary, driver's license, passport) except where required for a specifically credentialed program (e.g., union-bug-required apparel programs, certain government accounts). We do not collect health or biometric information. We do not collect children's information knowingly (see Section 12).

Section 4

How we use it

In short

To talk to you, quote you, produce your order, ship your order, bill you, and back-office stuff like keeping records and improving the site. That's it.

We use the information we collect to:

  • Respond to inquiries, route them to the correct division specialist, and follow up on quotes and proposals;
  • Produce, decorate, fulfill, ship, deliver, invoice, and provide post-sale service for orders;
  • Transmit your Customer Content to suppliers and contract decorators as necessary to produce your order (see Section 5);
  • Authenticate your account, maintain account preferences, and provide reorder-from-history convenience;
  • Maintain financial, tax, accounting, and order records as required by law and as needed to operate the business;
  • Communicate with you about your account, your orders, changes to terms or policies, and service announcements;
  • Improve the website, the catalog browsing experience, and our division content, based on aggregated page-view patterns;
  • Detect and prevent fraud, misuse, or unauthorized access; and
  • Comply with applicable law, respond to lawful requests, and enforce our agreements.

Marketing. If you submit a contact-form inquiry or place an order, we may follow up with relevant division information, case studies, and check-ins. You can opt out of marketing communications at any time using the unsubscribe link in those emails or by writing to privacy@powink.com. Opt-out applies to marketing; service emails (order confirmations, proofs, shipping notifications, invoices) continue regardless.

Section 5

Who we share it with

In short

ASI-credentialed suppliers and contract decorators who actually produce your order. The freight carrier handling delivery. Our hosting and email vendors. Payment processors. That's the list. We don't share with advertisers or data brokers.

We share personal information only with the following categories of recipients, only as necessary for the purposes described:

  • ASI-credentialed suppliers and contract decorators. Most orders are produced through an ASI-network supplier or decorator. To produce your order, we transmit the necessary order information and Customer Content (artwork files, decoration specifications, ship-to addresses, ship-by dates) to the supplier producing those goods. The supplier is contractually bound by ASI distributor terms regarding handling of customer data and artwork.
  • Freight carriers and logistics providers. Ship-to addresses, contact names, and order weights are provided to the freight carrier responsible for delivery.
  • Hosting, infrastructure, and email service vendors. Our website is hosted by Hostinger. Account authentication will be provided by Supabase. Email is sent via the email infrastructure we configure.   • Payment processor. Card and ACH payments are routed through our payment processor, which receives the payment information directly. [future — name specific processor once selected]
  • Professional advisors. Attorneys, accountants, and auditors, when needed and bound by confidentiality obligations.
  • Legal and safety. If required by law, valid legal process, or to protect the rights, property, or safety of POW Ink, our customers, or others (including responding to subpoenas, court orders, and law-enforcement requests we determine to be lawful).
  • Successors. If POW Ink is involved in a merger, acquisition, financing diligence, or sale of assets, personal information may be transferred as part of that transaction. We will require the recipient to honor the commitments made in this policy with respect to information transferred.

We do not sell your personal information. We do not share it with advertisers, ad networks, data brokers, data aggregators, list resellers, or any third party for those third parties' independent marketing or profiling purposes.

Section 6

What we don't do

In short

No selling, no ad networks, no cross-site tracking, no profile-building for advertisers, no third-party cookies, no fingerprinting.

We want this list explicit because most privacy policies bury it. POW Ink does not:

  • Sell, rent, lease, license, or "share" (in the CCPA cross-context-advertising sense) your personal information;
  • Use third-party advertising trackers, retargeting pixels, or cross-site behavioral profiling;
  • Build or maintain a marketing profile of you based on your browsing on this site;
  • Use a cookie-consent banner to extract consent for tracking we don't do (see Cookie Policy);
  • Buy, ingest, or enrich contact data from third-party data brokers;
  • Use the contents of customer artwork files for any purpose other than producing the order they were sent for, generating reorder-from-history convenience, and the customer-reference portfolio use described in our Terms (which you may opt out of); or
  • Train any third-party machine-learning model on your Customer Content, communications, or account data.
Section 7

Cookies and analytics

In short

We use minimal cookies — only what's required to keep the site working and to remember you while you're signed in. Our analytics provider, Plausible, doesn't use cookies at all. Full detail in the Cookie Policy.

Our use of cookies is limited and described fully in our Cookie Policy. In summary:

  • Strictly necessary cookies — session and CSRF cookies needed for the site to function and (once the portal launches) to keep you signed in. We do not require consent for strictly necessary cookies.
  • Analytics — provided by Plausible, which collects page-view information without setting cookies and without using persistent identifiers. Plausible does not track you across sites and does not enable individual-user analytics.
  • Future cookies — when we add Stripe-based checkout and OAuth sign-in via Google or Apple, those features will set their own session cookies. Those will be documented in the Cookie Policy at the time they go live, and will remain limited to authentication and checkout function.

You can control cookies through your browser settings. Refusing strictly necessary cookies will impair the function of any signed-in features.

Section 8

How long we keep it

In short

Order records: as long as we're legally required to keep them (typically 7 years for tax). Artwork files: 2 years after your last order, then we delete. Account data: until you delete the account. Inquiry-only contacts: routinely cleaned up.

We retain personal information only as long as needed for the purposes described in this policy, or as required by applicable law:

  • Order and invoice records: retained per applicable tax and accounting requirements, typically for at least seven (7) years from the close of the calendar year of the transaction. [ATTORNEY REVIEW — confirm specific ND record-retention requirements applicable to LLC bookkeeping and sales tax]
  • Customer Content (artwork files): retained for two (2) years from the date of your last order to support reorders, then routinely deleted. You may request earlier deletion at any time.
  • Account credentials and profile data: retained while your account is active, then deleted within thirty (30) days after account closure (see Delete your account) except for information we must retain for tax, accounting, or legal reasons.
  • Inquiry-only contact records (no order placed): retained no longer than twenty-four (24) months from last contact, then deleted unless we hear from you again.
  • Plausible analytics: aggregate analytics data only; no individual records to delete.
Section 9

How we protect it

In short

HTTPS for everything in transit. Authentication for anything sensitive. Access limited to the division and back-office people who need it. No system is perfectly secure, so if something goes wrong, we'll tell you.

We use reasonable administrative, technical, and physical safeguards designed to protect personal information against unauthorized access, alteration, loss, disclosure, and destruction. These include: transport-layer encryption (HTTPS) for site traffic; authentication and access controls on internal systems; role-based access to order, account, and artwork data on a need-to-know basis; and routine review of vendors and operational practices.

No method of transmission or storage is one hundred percent secure. If we become aware of a security incident affecting your personal information, we will notify you and applicable authorities as required by law.

Section 10

Your rights and choices

In short

You can ask us what we have on you, fix what's wrong, delete your account, opt out of marketing, and tell us not to use you in our portfolio. We respond to verified requests within 30 days.

Regardless of where you live, you have the following choices and abilities with respect to your personal information at POW Ink:

  • Access. Request a copy of the personal information we have on you.
  • Correct. Ask us to correct inaccurate or outdated information.
  • Delete. Ask us to delete your account and the personal information associated with it. See Delete your account for the dedicated request flow. Information we are required to retain for tax, accounting, or legal reasons will be retained as needed (Section 8) and otherwise segregated from active business use.
  • Opt out of marketing. Use the unsubscribe link in any marketing email, or write to privacy@powink.com.
  • Opt out of customer reference. Tell us in writing not to identify you in our customer portfolio or case-study content (see Terms § 10).
  • Withdraw consent. Where we relied on your consent, you can withdraw it; this does not affect prior processing.
  • Complain. If you believe we've handled your information unlawfully, you may contact us first at privacy@powink.com and, if unsatisfied, lodge a complaint with the applicable state attorney general or other regulator.

To exercise any of these rights, write to privacy@powink.com with enough information for us to identify you and the request. We may verify your identity by confirming details against information we already hold. We will respond within thirty (30) days, or within the period required by the applicable state privacy law if shorter.

Section 11

California, Colorado, and other state rights

In short

If you live in California, Colorado, Connecticut, Virginia, Utah, or another state with a comprehensive privacy law, you have additional rights — most of which we already extend to all customers in Section 10. We don't sell or "share" your data in the CCPA sense.

California (CCPA / CPRA). California residents have additional rights under the California Consumer Privacy Act, as amended:

  • The right to know what categories of personal information we have collected, the sources, the purposes, and the categories of recipients (this Policy provides that information);
  • The right to access specific pieces of personal information we have collected about you;
  • The right to delete personal information, subject to legal-retention exceptions;
  • The right to correct inaccurate personal information;
  • The right to opt out of the "sale" or "sharing" of personal information — POW Ink does not sell or "share" personal information as those terms are defined in the CCPA;
  • The right to limit the use of sensitive personal information — we do not collect or use sensitive personal information for purposes that trigger this right;
  • The right not to receive discriminatory treatment for exercising these rights.

To exercise California rights, contact privacy@powink.com. An authorized agent acting on your behalf must provide written authorization and may be required to verify their identity. We will respond within forty-five (45) days, with a one-time extension permitted under the statute.

Colorado, Connecticut, Utah, Virginia, and other comprehensive-privacy states. Residents of states with comprehensive consumer-privacy statutes have analogous rights of access, correction, deletion, portability, and opt-out from targeted advertising and sale. We do not engage in targeted advertising or sale of personal information. To exercise rights, write to privacy@powink.com. [ATTORNEY REVIEW — confirm state-specific response windows and any state-specific disclosure requirements; consider state-specific notices for FL, DE, OR, MT, IA, IN, TX, TN as those statutes come into effect]

"Do Not Track" and Global Privacy Control. Our website does not change behavior in response to "Do Not Track" signals (there is no industry-standard interpretation). Where we are required by applicable state law to honor Global Privacy Control (GPC) signals as opt-out preference signals for sale or sharing, we do so — but, again, we do not sell or share personal information.

Section 12

Children

In short

Our services are for adults and organizations. We don't knowingly collect information from kids under 13. If you find out we did, tell us at privacy@powink.com and we'll delete it.

POW Ink's services are intended for individuals at least 18 years of age and for organizations and businesses. We do not knowingly collect personal information from children under 13 years of age, consistent with the Children's Online Privacy Protection Act (COPPA). If you become aware that a child has provided personal information to us, contact privacy@powink.com and we will delete it.

Where we work with school districts, athletic programs, or youth-organization customers, the relationship is with the institution (which is acting as the contracting customer), not with any individual student or minor.

Section 13

International users

In short

We operate from the U.S. If you contact us from somewhere else, your information ends up here. We don't currently sell internationally and aren't a target for the EU/UK GDPR, but if you're contacting us from there, please don't send us anything you don't want stored in the U.S.

POW Ink operates in and from the United States. Information you submit will be processed in and transferred to the United States. By using the services from outside the U.S., you consent to the transfer of your information to and processing in the U.S.

We do not currently target services to individuals in the European Economic Area, the United Kingdom, or other jurisdictions with comprehensive data-protection regimes. Section 14

Changes to this policy

In short

We can update this policy. Material changes get a heads-up at least 30 days before they take effect, posted here and (if you have an account) emailed to you.

We may update this Privacy Policy from time to time. The "Last updated" date at the top of this page indicates when the current version became effective. For material changes — including new categories of collection, new categories of recipients, or new uses of personal information — we will post the revised policy at least thirty (30) days before it takes effect and, if you have an account on file, send notice to your account email.
